Who is the data controller and who is the data processor?
The organisation using Wyser ASSIST is normally the data controller because it determines why and how personal data is processed.
Wyser acts as the data processor when processing personal data solely for the purposes of providing the Service and in accordance with the customer's documented instructions.
The relationship is documented through a Data Processing Agreement which sets out the processing instructions, security measures, subprocessors, international transfers, assistance with data subject rights and other processor obligations.
The client should confirm its own controller status and identify any other processors or independent controllers involved in the wider process, such as its CRM system or telephony provider.
